Can my accident be covered under the Longshore and Harbor Workers’ Compensation Act (LHWCA) and the Jones Act simultaneously?

Video Transcription:

You’re either longshoreman or a Jones Act. The two acts are mutually exclusive so you can only be covered by one of those Acts. In certain states, you may be able to receive state worker’s compensation benefits and longshore benefits. Those are known as concurrent jurisdictions. Florida is not a concurrent jurisdiction state. Therefore, you’re either entitled to longshore benefits or benefits under the Florida Workers Compensation Act.
