What is an informal conference under the Longshore and Harbor Workers’ Compensation Act (LHWCA)?
When a dispute develops, the office of worker’s compensation programs will hold an informal conference. The conference is attended by a claims examiner, who’s an employee of the Department of Labor, the employee, the employer, or its representative, and if the parties have lawyers, then the lawyers will appear as well. The informal conference is just what it means; it’s an informal conference to try and resolve the dispute. Within a certain period of time after the informal conference, the claims examiner will issue a memorandum of informal conference with recommendations.
