Who enforces the Defense Base Act (DBA) and how?
The Defense Base Act is enforced by the United States Department of Labor. At the informal level, the Office of Workers Compensation Programs will attempt to resolve disputes. If those disputes are not resolved, then the matter will be referred to the Office of Administrative Law Judges, where an administrative law judge will hold a formal hearing, and issue a decision and order. If either party is dissatisfied with the decision and order, they may appeal to the benefits review board, and thereafter in certain circumstances, the United States district court, or more commonly, the Circuit Court of Appeals.
